2023 Revision

Pursuant to the revised statute, effective June 15, 2023, only one section was revised, 60-6A-37 Alcoholic beverage delivery permit, A. and E.(6) modified, the division has provided the revised statute book by email to current licensees.

 

2021 Revisions, New Applications:
Pursuant to the new statutes, effective July 1, 2021, the division has provided applications to licensees wanting to avail themselves of the new options for their liquor licensing.

 

Existing Restaurant Licensees that have held their license for at least 12 months are eligible to add the +NM Produced Spirits Permit to their license. In addition to beer and wine, it allows for the sale and service of New Mexico spirits produced by or for a New Mexico Craft Distiller.

 

Existing Restaurant Licensees are eligible to convert their A-type license for beer and wine to a B-type license allowing the sale and service of beer, wine, and any spirit.

 

Inter-Local Licensees or Dispenser-Type Lessees, with a valid food permit are eligible for converting to a Restaurant B license, allowing for the sale and service of beer, wine, and any spirit.

 

Qualified Liquor License Holders can now apply for an Alcohol Delivery Permit.

HOURS for SALE/SERVICE OF ALCOHOL

Effective July 1, 2021, restrictions lifted for Christmas Day and Sunday sales.

 

Package Sales, the hours of service are 7:00 a.m. until midnight.

On-Premises Licensees, the hours of service are 7:00 a.m. to 2:00 a.m.

For Restaurant License Holders, hours are from 7:00 a.m. until 11:00 p.m. or when food service stops, whichever is earlier.

This will apply to the entire state, except for Local Option Districts in McKinley County, which are allowed to enact ordinances restricting sales between 7 a.m. and 10 a.m. for package sales.

 

SUNDAY SALES:

Effective July 1, 2021, Sunday sales fees will no longer be imposed, and a Sunday sales stamp on the liquor license will no longer be required. The hours of sales and/or service will be the same as establishment hours for all other days of the week.
